Terms of Use

Please read these Terms carefully before using Dice. By downloading or using the app, you agree to be bound by these Terms.

Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Dice application ("App") for iOS and macOS, developed and operated by Dice ("we," "us," or "our"). By accessing or using the App, you agree to be legally bound by these Terms. If you do not agree, do not use the App.

These Terms also constitute the end-user license agreement contemplated by Apple's Licensed Application End User License Agreement. Where these Terms are silent, Apple's standard EULA applies.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control and that runs a supported operating system, solely for your personal, non-commercial purposes, in accordance with Apple's App Store Terms of Service and the usage rules described in Apple's Licensed Application End User License Agreement.

Restrictions

You agree not to:

Copy, modify, reverse engineer, decompile, or create derivative works of the App, except to the extent applicable law expressly permits
Use the App for any unlawful, harmful, or fraudulent purpose
Attempt to gain unauthorized access to any systems, networks, or other users' accounts
Resell, sublicense, rent, lease, or distribute the App to third parties
Remove or alter any proprietary notices within the App
Circumvent, disable, or otherwise interfere with any feature that enforces limits on use, including the Pro entitlement check

Dice Pro Subscription

Some features of the App — including premium dice themes, premium sound packs, saved roll presets, and tally histograms — are available only with an active "Dice Pro" auto-renewable subscription, purchased through the Apple App Store.

Billing

The subscription price displayed at purchase will be charged to your Apple ID at confirmation of purchase.

Auto-renewal

The subscription automatically renews at the same price for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.

Managing & Cancelling

Manage your subscription and turn off auto-renewal at any time in your Apple ID account settings (App Store → your profile → Subscriptions, or System Settings → Apple ID → Media & Purchases → Subscriptions on macOS). Cancellation takes effect at the end of the current paid period.

Free Trial / Promotional Offer

Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription.

Refunds

Refunds are handled by Apple in accordance with the App Store's refund policy. We cannot issue refunds directly.

Price Changes

If we change the subscription price, Apple will notify you and request your consent before the new price takes effect, as required by Apple's policies.

Intellectual Property

The App and all of its content, features, and functionality — including but not limited to graphics, design, code, and sound — are owned by us or our licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you, except for the limited license granted in Section 2.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES, AND WARRANTIES REGARDING THE ACCURACY, FAIRNESS, OR RANDOMNESS OF ANY DIE ROLL, NUMERIC OUTCOME, OR OTHER RESULT PRODUCED BY THE APP.

THE APP IS A NOVELTY AND ENTERTAINMENT UTILITY. RESULTS PRODUCED BY THE APP MUST NOT BE RELIED UPON FOR GAMBLING, WAGERING, LEGAL, FINANCIAL, MEDICAL, OR ANY OTHER DECISION OF CONSEQUENCE. YOUR USE OF THE APP IS SOLELY AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL; DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP; DAMAGES ARISING FROM ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR DAMAGES ARISING FROM ANY THIRD-PARTY CONDUCT OR CONTENT. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To the extent permitted by law, our total cumulative liability to you for all claims arising from or related to the App shall not exceed the greater of (a) the amount you paid us (through Apple) for the App or any subscription in the twelve (12) months preceding the event giving rise to the claim, or (b) five U.S. dollars (US$5.00).

Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.

Third-Party Services

The App integrates with Apple StoreKit for in-app purchases. We are not responsible for the practices or content of any third-party services. Your use of such services is governed by their respective terms and privacy policies. See our Privacy Policy for details.

Apple-Specific Terms

You acknowledge and agree that these Terms are entered into solely between you and us, and not with Apple Inc. ("Apple"). We — not Apple — are solely responsible for the App and its content. The following additional provisions apply:

Scope of License

The license granted in Section 2 is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

Maintenance & Support

We — not Apple — are solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation to furnish any maintenance or support services.

Warranty

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.

Product Claims

We, not Apple, are responsible for addressing any claims relating to the App or your possession and use of it, including product liability claims and claims arising under consumer protection or similar legislation.

Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that Apple will have the right to enforce these Terms against you as a third-party beneficiary upon your acceptance.

In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, the Apple Media Services Terms and Conditions shall govern with respect to your relationship with Apple.

Modifications to the App or Terms

We reserve the right to modify, suspend, or discontinue the App, or any feature within it, at any time without notice. We may also update these Terms at any time by updating the "Effective Date" above. For material changes, we will use reasonable efforts to notify you in-app or via the App Store. Continued use of the App following any changes constitutes your acceptance of the revised Terms.

Termination

These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically, without notice, if you fail to comply with any of them. Upon termination, you must stop using the App and delete it from your devices. Sections that by their nature should survive termination (including Sections 5 through 10 and 13 through 15) will survive.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions, and excluding the United Nations Convention on Contracts for the International Sale of Goods. Any disputes not subject to mandatory consumer protection laws of your country of residence shall be resolved exclusively in the state or federal courts located in California.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and (where applicable) Apple's Licensed Application End User License Agreement, constitute the entire agreement between you and us with respect to the App and supersede all prior and contemporaneous agreements, representations, and understandings.
