1. Agreement to these terms

These Terms of Use ("Terms") apply to the FoldOut: Cube Folding Puzzle app (the "App") and the FoldOut Pro subscription. "FoldOut", "we", "us" and "our" mean the developer of the App. By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Licence to use the App

The App is licensed to you, not sold. Your licence is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms add to the Standard EULA. If anything in these Terms conflicts with the Standard EULA, the Standard EULA takes priority to the extent of the conflict.

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable licence to use the App on Apple devices that you own or control, as permitted by the App Store's Usage Rules.

3. FoldOut Pro subscriptions

The App is free to download and includes a free set of features. FoldOut Pro is an optional auto-renewable subscription that unlocks additional features, currently all face styles, longer sessions, saved history with progress trends, and all-time accuracy breakdowns.

Plans and pricing

  • FoldOut Pro Monthly: renews every month.
  • FoldOut Pro Yearly: renews every year.

The current price of each plan, in your local currency, is shown in the App before you confirm a purchase. Prices may vary by country and may include applicable taxes.

Payment and automatic renewal

  • Payment is charged to your Apple Account when you confirm the purchase.
  • Your subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the current period ends.
  • Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the then-current price of your plan.
  • If the price of your plan changes, Apple will notify you in advance and, where required, ask for your consent before the new price applies.

Managing and cancelling

You can manage or cancel your subscription at any time in your Apple Account settings. On iPhone or iPad, open Settings › [your name] › Subscriptions. On Mac, open the App Store › [your name] › Account Settings › Subscriptions. You can also use Manage Subscription inside the App.

If you cancel, you keep access to FoldOut Pro until the end of the period you have already paid for. Cancelling does not delete your on-device practice history.

Switching plans

Both plans belong to the same subscription group, so you can switch between monthly and yearly at any time. Apple determines when the change takes effect and how any remaining time is credited.

Restoring purchases

If you reinstall the App or use another device signed in with the same Apple Account, tap Restore Subscription on the FoldOut Pro screen to restore access.

4. Free trials and offers

We may sometimes offer a free trial or introductory price. The length and terms of any offer are shown before you subscribe. Unless you cancel at least 24 hours before a free trial ends, it converts automatically into a paid subscription at the regular price. Any unused part of a free trial is forfeited when you buy a subscription.

5. Refunds

All purchases are processed by Apple, and we cannot issue refunds ourselves. If you believe you are entitled to a refund, you can request one from Apple at reportaproblem.apple.com. Refunds are handled under Apple's policies and any consumer rights that apply in your country.

6. Acceptable use

You agree not to:

  • copy, modify, reverse engineer or create derivative works of the App, except where the law allows this despite these Terms;
  • get around or interfere with subscription checks or other access controls;
  • use the App for any unlawful purpose; or
  • rent, lease, sell or redistribute the App or its content.

7. Intellectual property

The App, including its design, artwork, question generator, animations, text and the FoldOut name and logo, is owned by us and protected by intellectual property laws. These Terms do not give you any rights to our trademarks or content beyond the licence in Section 2.

If you send us feedback or suggestions, you allow us to use them to improve FoldOut without any obligation to you.

8. Educational purpose

FoldOut is a practice tool for spatial reasoning. Its questions are designed to resemble cube-folding questions in aptitude and spatial reasoning tests, but FoldOut is not affiliated with, endorsed by or connected to any test publisher, school, employer or examining body. We do not guarantee any particular score, result or outcome in any test or assessment.

9. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the App will be uninterrupted, error-free or free of harmful components. This section does not limit any rights you have under consumer protection laws that cannot be excluded.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid for FoldOut Pro in the twelve months before the claim arose. Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. Apple is not responsible for handling any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer protection claims, or claims that the App infringes someone else's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Termination

Your licence lasts until it is ended by you or us. You can end it at any time by deleting the App. It ends automatically if you fail to comply with these Terms. Ending your licence does not cancel an active subscription. Please cancel it through your Apple Account as described above.

13. Changes to these Terms

We may update these Terms from time to time, for example to reflect new features or changes in the law. We will post the updated Terms on this page and change the "Last updated" date. If a change materially affects your rights, we will make reasonable efforts to tell you, for example through the App. Continuing to use the App after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the place where the developer of the App is established, without regard to conflict-of-law rules. Nothing in these Terms takes away any mandatory consumer protection rights you have under the laws of the country where you live.
